In December 1993, the United Nations High Commissioner for Human Rights published the Declaration on the Elimination of Violence against Women [3]. This establishes marital rape as a human rights violation.

"Violence against women shall be understood to encompass, but not be limited to, the following:


(a) Physical, sexual and psychological violence occurring in the family, including battering, sexual abuse of female children in the household, dowry-related violence, marital rape, female genital mutilation and other traditional practices harmful to women, non-spousal violence and violence related to exploitation;


(b) Physical, sexual and psychological violence occurring within the general community, including rape, sexual abuse, sexual harassment and intimidation at work, in educational institutions and elsewhere, trafficking in women and forced prostitution;

I'd also like to add that any form of forced sexual penetration is rape. Limiting the penal code to vaginal penetration seems rather naive.

i personally think as long as one is forced into doing something one doesn't want to, or doing something one is totally not comfortable with, then a wrong would have occurred against that person, and the doer should naturally be punished for forcing that wrong on that person. simple?
